Can I Still File a Claim Weeks After a Car Accident in Florida?

car crash accident. Car collision on city street. Two damaged automobiles

This is one of the most common questions asked after a crash, especially when symptoms appear later or insurance issues start surfacing.  The short answer is: yes, in many cases, you can still file a claim weeks after an accident, but timing is extremely important.

Florida’s laws give injured individuals specific deadlines, and waiting too long may affect your ability to recover compensation.  Here’s what you need to know.

Florida’s Timeline for Filing a Personal Injury Claim

Florida generally allows two years from the date of the accident to file a personal injury lawsuit.  This time limit is called the statute of limitations.

While two years may seem like a long time, many people don’t realize the clock starts on the date of the accident itself, not when symptoms begin, not when insurance delays start, and not when paperwork is requested.  If you wait weeks or months to take action:

  • Evidence may be harder to gather
  • Witnesses may be more difficult to locate
  • Medical documentation may be incomplete

Even so, filing a claim weeks after an accident is often still well within the legal timeline, and many valid Florida car accident claims are initiated after some delay.

What If You Didn’t Realize You Were Hurt Right Away?

This is extremely common.  Soft-tissue injuries, whiplash, back pain, and concussion symptoms can take days or weeks to become noticeable.  Florida law does not require you to feel pain at the scene, only that the injury resulted from the crash.

If symptoms appeared later, you can still:

  1. Seek medical evaluation
  2. Notify insurance
  3. Speak with a personal injury attorney

A delayed medical visit does not automatically prevent you from having a claim.  However, insurance companies may try to use delays to question whether the injuries were caused by the accident.

It is also important to understand that Florida’s Personal Injury Protection (PIP) coverage generally requires that initial medical treatment be sought within 14 days of the crash in order to access PIP benefits.  Missing that deadline does not necessarily bar a bodily injury claim, but it can affect available insurance coverage.

When to Contact an Attorney

If you are unsure about your timeline or you were injured but didn’t act immediately, speaking with a personal injury attorney can help you understand what options may be available based on the circumstances.
